Hi there:your daughter needs to start by filing for custody. Custody is awarded based on the best interest of the child. Your daughter would need to make her case as to why it is in her child's best interest to have sole custody. If the father never visits, calls, etc., that is ordinarily a good basis for sole legal and physical custody. In fact, if he is completely absent, she may wish to consider filing to terminate his parental rights altogether.It all starts at the courthouse. Go there and ask for the child custody forms.
