I am a married woman, who is in the middle of a separation. I've been married for 24 years. The house is in my name alone, and was in my possession before we married. My husband has left the house for a few days according to my wishes. He wants to stay in the fron bedroom until we figure things out. I want to change the locks, and give him limited access to his things, or ask him to clear out everything asap.We have a prenuptual agreement. He has to pay me no alimoney. The house is my sole property and not his. Do I have the right to change the locks? He has been paying the mortgage for a number of years.
State/Country relating to Question: California Already Tried: New situtation. Just want to change the locks before he returns on Tuesday.
You do not have the right to change the locks, unfortunately. This is why: Your husband has become a de-facto tenant on the premises. As such if you want him to leave, you would have to initiate eviction proceedings, as if you were the landlord and he were the tenant. Sincerely,Dimitry Alexcander Kaplun, Esq.
