I need to pay some one back for a trip I sold through our auction site. The travel agent ran with the money. What is the laws for how many days my charity has to pay back the winner of this cruise that she did not get. The travel agent owes our donor $2498 but they are Canadian citizens and we think they ran out of the US. Since we sold the trip I heard it is our responsibility to pay back the donor.True or False
State/Country relating to Question: Florida Already Tried: To get in touch with the travel agent,. We have a letter from our donors attorney who is going to sue our foundation for the money that we do not have
Hello -Thank you for contacting JustAnswer.Since the exchange was between you and the donor, you are responsible for delivering the cruise or refunding the money. Your remedy is to sue the Travel Agents for the money they "stole" from you.Hope this helps,If my answer was helpful, please click ACCEPT so i may be compensated for my time. I know we are responsible for paying her back but what is the law with how many days we have to pay her back and can we make payments
Thanks for your response. There is no specific law stating the amount of time you have to pay the donor back. However, according to contract law, because you did not provide the trip, you are liable for the entire amount immediately. This does not mean you can not work out a payment plan with the donor, but it does mean that the donor may sue you to recover the money immediately if they do not want to accept a payment plan. I would certainly contact the attorney you got the letter from, and explain that you will pay what you owe in payments. This is a much better solution than them taking you to court and getting a judgment against you, which sometimes can take a while.
