State/Country relating to Question: Georgia Already Tried: I wrote the collection firm telling them I did not think I was liable for this debt, they filed a civil lawsuit
When did you last make a payment or incur a charge?
Last payment to credit card company was made September 2006
The claim is not time barred. Consider negotiating a payment plan settlement seeking a reduction in balance.
This account was opened in 2002 and written off by the credit card company in 2007. I'm I still liable on this open ended account?
If you made a payment in 2006, the statute of limitations runs from then. The fact it was written off does not make it not collectible. That is only an internal matter. If you were released in writing, then they could not collect.
What is the statue of limatations in Georgia?
It is 6 years from the date of the last charge or payment whichever is later. Kindly accept my answer.
