On the form FL-100 the California dissolution of marriage document that I was served, my wife did not check off the box regarding alimony and has commented before that she does not want any. She did check off the box on Form 110 stating that she "waives the courts ability to have petitioner pay respondent support". She left blank "Spousal support payable to "Petitioner", "Respondent", "Joint", "Other" Can the courts force alimony if even if she is not asking for it? If so, with our short marriage of less than four years how many months of alimony am I obligated to? She is currently working three jobs and collects $2,100 disability from the death of her first husband.
State/Country relating to Question: California
Hi there: In California, for a short-term marriage (less than 10 years), alimony may typically be granted for half the term of the marriage. The courts will not order alimony unless the parties specifically ask for it.
