i hosted a public event on my property for motorcyclists. We had sled races and were approved by the town and county executive that we could shut down a portion of a town road for a certain time for a motorcycle stunt show. We have a letter give me the permission to do this and the day of the event the state police of new york and state park police set up road blocks on each end of thisXXXXXonly those way in or out and they stopped every motorcycle issuing tickets for everything they could possibly find, on top of that they said we cannot shut the road down or arrests will be made to anyone involved. i was unable to get ahold of the county executive who gave us permission or any town member for that matter so we did not continue. This cost us alot of money in people who did not want to wait for the road block and or were ticketed for minor things. the police officers on scene stated that the county executive who gave us permission revoked it without notifing me, this was false
State/Country relating to Question: New York Already Tried: nothing, we have much of the police officer statements on video. this was a charity event that was going to the make a wish foundation in which the police cost us many entrys. people turned around not wanting to be hassled over an aftermarket exhaust or a blown light bulb etc. I did speak with the county executive and he told me that he NEVER told the state police to shut us down and or set up road blocks.
Thank you for using JustAnswer! I am sorry for what occurred to you. What is your question that you would like assistance with?
Can i go after the state police for anything in this case? I feel they were not just in what they did, can i sue for loss of money? anything at all?
Sorry but you can't. The State Police have immunity. So long as they believe that they were enforcing the laws of the road, they are immune from liability. The facts that you describe reflect a huge communication breakdown between governmental agencies (which does happen) but the laws were not violated. Good luck and best wishes. I hope that you find this information to be helpful in better understanding where you stand and why. I also hope that you find this answer to be ACCEPTable!
just so im clear, the police lied on video to us causing us to not hold our event, and we cant do anything about it?
That's correct. The assurances/permission given to you by the county executive did NOT bestow upon you some type of constitutional rights/protections which the state police took away by their lies. The State Police enforced the laws as they understood them. Even if they were wrong in their understanding. Even if they lied about it, in these circumstances, they have governmental immunity and will have a quick win if you tried to sue them in court. This is not to say that what happened was right. Rather, because they have governmental immunity, they cannot be held legally responsible for it.
ok, what your saying is they did not falsly take away any of my constitutional rights so they are not liable. now in that situation where we had permission from the town, if we were to shut down the road anyways, and they came in broke it up made some arrests and gave some tickets, would they hold up in court in your opinion if we could infact prove the road was leagally shut down?
That will be for the judge to decide. If the county executive shows up in court and says that's what happened, then that outcome is possible.
