X proposed to Y, they have lived together for a year. The next day X said that he would only go through with the engagement if she signed a prenuptial agreement. If she does not she must move out at months end. Y felt pressured but signs the agreement in which she must lose 20 pounds before a certain date for the marriage to go forward. She did not. Under the agreement she must move out and loose all household belongings. Should the agreement be enforced?
No, The subject matter of the agreement is unenforceable since one of the parties provided no valid consideration for the agreement (getting married is not valid consideration). Sincerely, Dimitry Alexander Kaplun, Esq.
im a paralegal student, and i really dont understand this situation.. can u please expain it to me ? i thougth that it was a valid contract, since the girl signed the agreement. am i wrong??
It is arguable, but I will try to explain further. Remember that each party must offer some sort of valid consideration to make the agreement enforceable. Getting married is covered by the engagement; putting weight as condition to marriage is valid because it is a conditional offer. But forcing the other person to LOSE all of her items if she does not lose weight is unenforceable, since the other party did not place anything in the contract as their valid consideration. (If the agreement read, "I hereby promise to lose 20 pounds within 6 months or I lose my interest in items A, B, and C. Party B hereby promises to pay me $100 at end of 6 months should I lose 20 pounds." then it would be legal). Hope that made more sense to you. Sincerely, Dimitry Alexander Kaplun, Esq.
