Hilton Garden of Roanoke Rapids, NC, called the police on my sister for an "outstanding warrent" that turned out to be a subpoena. Then kicked me out of the room, that I paid $109 dollars for, and was only in for 15 minutes. Then, continued to go on the power trip of charging my debt card an extra $343.44 for smoking a cigar on the patio of my room. The on-site manager stated that it was a non-smoking room and smoking on the outdoor patio was considered part of the room, and smoke damage was done to the room of $250. How can they do this to me? I did not agree for him to debt this money from my account, did not receive a receipt, what can I do? What attorney would agree to take a law suite againt the infamous Hilton Gardens?
State/Country relating to Question: North Carolina Already Tried: Spoke with my bank, filed a dispute. Spoke with GM "that made these claims to my cc", who was rude with me. Called the hilton gardens customer service, and was instructed to call back in the morning.
Hi there: it probably isn't worth the expense of getting an attorney involved, but if what you say is true and can be proven, your odds are excellent that you could recover the full amount + your other damages in Small Claims.
How would I go about proving this? Taking out a small claims?
I don't understand the second part of the question. Please clarify?
How do I start a small claims? What is a small claims? What is the process? How would I begin in getting my money back?
Small claims is a way to sue for relatively small civil cases. You would start by visiting your local courthouse and requesting their forms for filing a small claims action. Then, you would fill out the forms and take it from there.
