how can i have a dna from a person that i suspect he raped me and left a condom in my bedroom . the police said that they cannot force him to do that. it has been a year ago and this person moved to another state.
State/Country relating to Question: Iowa Already Tried: excluded that the condom can be to my husband after a DNA test . and talked to the police about it but they said they cannot make the person that i think he did it ( because i was not really awake in my own bedroom) do a dna test.
<p>Hello,</p><p> </p><p>There are numerous ways to obtain DNA from someone but you would have to get something that he had discarded in order to get it without a court order. A cigarette, tissue, hair sample, etc. can all yield DNA that you can then have tested for a match. It sounds like the police never charged the suspect and it might be difficult for you to get a sample, but it can be done. i know these things already, but how can i convince the police to order this person give his dna or can a lawyer help with making this person give his dna?
Unless the prosecutor has charged him with a crime, the police can not take a sample. That is why I suggested that you obtain the DNA. There is no way to compel him to provide a sample unless you obtain it, he voluntarily gives it, or he is charged with a crime and a judge orders it.
You could approach a Victim's Advocate with the court and see if they could press your case with the prosecutor's office, but it sounds like they have looked at it and decided not to proceed with any criminal prosecution.
