Could someone please tell me what the Statute of Limitations for legal malpractice is in South Carolina and if there are any agressive attorneys willing to sue another attorney?
State/Country relating to Question: South Carolina Already Tried: I was unfairly represented in a building dispute with my contractor. My attorney did absolutely nothing to represent me, told me repeatedly that the builder has no assets and that I should settle. The builder had property that he had not sheltered that is probably worth hundreds of thousands of dollars if not more. It took the mediator two minutes to pull the information up on the computer. My attorney ignored me when I told him I wanted to go to trial and insisted that I should settle for practically nothing. I am in debt over three hundred thousand dollars and am sure that I have a case against this lawyer if the statute of limitations has not run out and if I could find an attorney who would sue another attorney. Please help me. Thank you.
The statute of limitations for professional malpractice in South Carolina is 3 years from the date of the cause of action (the date malpractice was committed). Since there is no guarantee that any given attorney would be willing or able to take any particular case, my recommendation would be to access www.martindale.com to find attorneys in your geographic area that meet your experience and area of practice requirements. This is the tool that most attorneys use when looking for legal experts outside their own jurisdictions. Let me know if I may be of further assistance, and please remember to click "accept". Thank you.
