I have a so called "friend" accusing my husband of hacking onto all of her personal e-mails and online accounts(myspace and facebook). She found some bogus e-mail on her account privacy settings that was not hers, then searched for it on facebook and found an account with no picture or information, and the only firned they have is my husband. She is now stating that she is pressing charges against us. What ground does she have to stand on with this issue, and what should my husband and I do?

It needs to have proof or else could be subject to a slander claim. Slander requires showing false statements made to another causing harm to reputation and financially. It is an expensive and time consuming lawsuit. Consider also if the defendant has any money to collect assuming you succeed and obtain a judgment. The only only proof that this person claims to have is just the record of the bogus e-mail being changed in her account, and her finding my husband being a friend on to the facebook account attached to that e-mail. I dont beleive either are valid forms of proof, but I do not know what would proof would be needed in court. Could you tell me what would be needed in order for anyting to go to court?
The problem is that you need to show financial harm, to pursue a slander claim. Given the cost of the lawsuit and this problem, a lawsuit is not a good idea. A lawyer letter may scare her not to pursue it further either.
