I was fired on April 2009. AFter a few arguments with my manager over food being left in the refrigerator, a few weeks later I was written up on several false claims - sleeping on the job, not being at my post, etc... which as a security officer, if the claims were true, should have been caught on camera. I work very hard but I was wrongfully fired over false claims and I even challenged them to show proof on tape. Please help me..
State/Country relating to Question: California Already Tried: complained to my union rep - nothing happened
It sounds like you may have a valid claim over retaliation and wrongful termination. What state are you in so I can look up the agency that can help you?
California
Contact the US Equal Employment Opportunity Commission. Their link is here: http://www.eeoc.gov/sanfrancisco/area.html Be aware that you only have 180 to file from the alleged date of the wrongful termination based on retaliation. Good luck! Sincerely, Dimitry Alexander Kaplun, Esq.
what do you mean by 180
oh, I am sorry. I meant to type "180 days" to file. In other words, if you were retaliated against in April, you are getting very close to the 180 days in which you can file a formal complaint so I suggest you do not delay and contact them right away. Sincerely, Dimitry Alexander Kaplun, Esq.
do i need a lawyer? if yes, can you recommend a lawyer that doesn't require payment right away but will agree to get payment after there is a settlement?
To speak to the EEOC, you do not quite need a lawyer. You can have one, but to file a complaint you can do it yourself and save yourself some money. If you get what is called a "right to sue" letter from the EEOC, then you would need representation. Sincerely, Dimitry Alexander Kaplun, Esq.
