Spring 09, Matt's mom, Sue towed a car to his house w/o license plates, key, registration, title, etc., dumped in front yard. Prior, Sue had discussed purchasing the car with 15 yr.old Matt, w/o mentioning to his Dad, her former husband who has custody. Matt gave her $1500, all of his savings because his mom said "she needed the money". Kelley Blue Book is: Excellent - $1,460, Good-$1,235, Fair-$910, trade in value around $525. I, GF, finally called Sue to tell her grass under car was dying & we needed key to move car & asked what the deal w/it was. Sue said she wanted another 1500 for it or would take $1000 cash tomorrow. I told her the value and asked for title, reg and key. She said she'd just come get it. Matt and dad agreed she could take it and return the $1,500. She doesn't have the money now & no money for registration or inspection either. What are Matt's legal rights, since he was only15 when he made deal? How can he get $ back or get car w/o suing mom? Send certified lett?

Thank you for using JustAnswer! Because Matt is only 15, no enforceable contract was created. Matt is not able to enter into a contract. Sue needs to get the car and return the money ASAP or the police are called about the abandoned vehicle and she is sued in Small Claims court. Dad can send a certified letter on Matt's behalf demanding that the car be removed and $ returned to Matt by X date or police will be called and suit will be filed. Good luck and best wishes!
