I was in California for a work up for a liver transplant.. We stayed at the Double Tree Hotel in Beverly Hills. The last night we were there I got in the hot tub and contracted E-coli in my left leg from a small cut. I live in Oklahoma and upon returning got very ill and was admitted to the hospital in ICU with the infection. Within 1 month I had to have my leg amputated do to the E-coli from the Hot Tub. My leg was amputated in March 2006. Do I have a case?
State/Country relating to Question: California Already Tried: Nothing
If you got this serious injury as a result of poor condition at the hotel, you can indeed pursue the hotel for your actual and punitive damages. That should be done through a lawyer. You should also file a complaint with the dept of consumer affairs and the BBB.
What is the statute of limitations on this type of case?
In California its a 2 year period from the event.
So is it too late to persue this.? Since I live in Oklahoma does that make a difference in the statute?
The statute is 2 years in Okl as well. Consider having a personal injury lawyer reach out to the hotel threatening suit and see if a settlement can be negotiated.
