Attorney General filed ORIGINAL PETITION FOR SUIT AFFECTING PARENT CHILD RELATIONSHIP on 8/19/09 in Dallas County for biological mother and father. Grandparents are trying to intercede and ask for custody under grandparents rights that child lived with them for more than 6 months and terminated less than 90 days prior to filing order... Except they filed their ORIGINAL PETITION FOR SUIT AFFECTING PARENT CHILD RELATIONSHIP in Tarrant County on 9/9/2009 via private attorney. Since Attorney General filed case first and in Dallas County, Dallas County has jurisdiction correct? So in order for the grandparents to try and intercede they would have to refile in Dallas County correct?
State/Country relating to Question: Texas Already Tried: Waiting to get retainer fee for an attorney to represent our case.
Thanks for your question.Well you will need to file motion to dismiss here in Tarrant County and you have to get it dismissed.Note that the AG represents you here in child support only. They will not help you here in custody suit. You may well need a private lawyer here if you want to maintain custody. There are two different suits about two different issues. But you are correct the Tarrant County suit my be motioned and dismissed.
