I'm being sued for over 10,000 dollars. My son called me, asked to cosign for a truck. Said yes, and go to dealership. Found out his credit was not good. That, I had to sign for the truck, I did. Long story short, truck was taken back by Chrysler. He had the truck for about a yearl Want can I do in court to stop it. I'm disable,Social Security, Va Comp, very small pension. I've been making payment for 150.00 a month. I've made 1,062.00 to one company.Now a attorney for Chrysler is handling the case.Calls me up ,tells me to send payments to them. Three months goes by, I have to appear incourt, being sued. So far, I've paid back 750.00. Total so far 1,712.00 in nine months. I want to fight back. I agreed to make the payments,and they want to sue. Thank you

As a co-signer, you are "jointly and severally" liable for the debt on the truck. In that sense Chrysler does have the right and ability to bring suit against you to recoup their losses. You will not be able to stop their suit unless you can somehow show that you did not sign the paperwork, or you were lied to about what the paperwork stated--and there is nothing in your facts that indicate such a situation. What you can do is show that the company is not acting in good faith with you. You have been making regular payments as promised, and you have been upholding the debt as well as you could, but the company, without outside cause, is still attempting to bring suit against you for the full amount. I suggest you contact the party who is suing you, and attempt to compromise a modified payment plan that works for both sides. Explain that even if they bring suit against you, as someone on disability and SSI, many of your accounts cannot be garnished so even if a judgment is won against you, they will have a hard time collecting.
