I was just terminated from my job 3 weeks ago for falsifying an expense report. I admitted to the falsification and was terminated. The employer I worked for did not want to press charges nor for me to pay any restitution. My former employer also stated that they would still give me a reference to new employment inquires. I had been a long time and outstanding employee until then. I am now trying to collect unemployment benefits and will be called upon to explain what had happened. I'm concerned that the EDD will either deny any benefits or maybe obligated to reference this to authorities since this was actually a theft. Please give me any information on what I may encounter. Legally the employer has discretion to terminate. The employer in contesting your claim for benefits would have to show and not merely allege that there is cause for the termination. If it cannot you would qualify
I also had a 2nd part to this question. Is the EDD obligated to report this to any authority? Since this was actually a theft.
