I have been renting a room in a private home for a little over a year. Yesterday, the homeowner, who does not live in the home but visits frequently as his mother also lives in the house, asked me be with him sexually. He is a married man, I am very well aquainted with his wife and his children and my child play together often. Now I feel weird about continuing to live here and feel that he took advantage of his position of power to pressure me. Is this sexual harrassment? After I told him I was not at all interested, he continued pressuring me. I am on a month to month lease. Was his behavior sexual harrassment?
State/Country relating to Question: California Already Tried: So far I have gone looking for apartments. I'm still kind of in shock about the whole thing. I've lived here for a year with no problems.
Sexual Harassment is defined as unwelcome sexual advances, requests for sexual favors and other verbal or physical conduct of a sexual nature when: (1) submission to such conduct is made a term or condition of employment or participating in educational programs; or (2) submission to or rejection of such conduct is used as a basis for employment or academic decisions affecting the individual; or (3) such conduct has the purpose or effect of unreasonably interfering with an employee's work performance or student's academic performance creating an intimidating , hostile, or offensive working or learning environment. Since you are not employed by him, this would not constitute sexual harassment. This may, however, constitute simple harassment, and you can request that he stop his behavior, or you will be forced to file a restraining order against him. Sincerely, Dimitry Alexander Kaplun, Esq.
