I bought a car from a dealer in nyc and while signing the financial papers I told the person that I was on the "s-plan"which entitles the person to purchase the car at dealer cost. Well ,I took the car home that night and never looked at the contract. When I saw the contract a day or two days later I saw that the financial person had charged me the sticker price instead of the "S-plan" price .I have requested that they look into it and call me back ,but they have not done so . What are my options ?
State/Country relating to Question: New York Already Tried: I told the manager and finace officer of the dealership that I was not charged the correct amount on the new car purchase because the finance officer did not give me the "s-plan" price which happens to be dealer cost.
Unfortunately, you need to hope the dealer is reputable and honest, since the courts hold persons liable for reading and understanding contracts before they sign them. Oral agreements or statements are not allowed in court to counter the contents of a contract that you signed. You could try to argue Fraud/misrepresentation or mistake/lack of meeting of the minds to seek to void the contract, but this would mean a protracted legal battle if the dealership will not acquiese and correct the contract.
