I was living in Costa Rica and got married, however after only 3 weeks we both decided it wasn't a good idea. This was around Christmas and in Costa Rica everything is closed down for 2 or 3 weeks. I contacted a Costa Rican lawyer and paid him, he told me because the marriage wasn't recorded yet, it would be a simple matter to get it annulled. I left for Nicaragua and met another girl and we got married in Nicaragua, she immigrated to Albuquerque, New Mexico with me, we've been living here for 2 years. Now all she talks about is getting money from me through a divorce. I just found out the lawyer in Costa Rica never did have my marriage annulled and now it is recorded in Costa Rica. From talking to others, Costa Rican lawyers ripping off gringo clients happens all the time. Both marriages were overseas. Where am I legally?
State/Country relating to Question: New Mexico Already Tried: I'm worried if she proceeds with a divorce I'll be force to sell my home, which i have owned years before we were married. she seems only interested in how much money she can make from this, and yesterday she has talked to a lawyer. However, she didn't say anything about my prior marriage. I don't know where i stand legally, or where she stands for that matter.
Hi butchie,
From your facts, it appears that your marriage #2 was not valid, it never was a legal marriage. Little miss greedy in NM can take her dollar signs to the next guy and try to take him, because it does not appear she can divorce you since she never legally married you.
I would get my papers together proving you are still married to #1 and that the divorce failed to happen. However, I would definitely get an attorney - to make sure none of this gets twisted into bigamy allegations. Since the marriage #2 didn't happen here in the States, that may be a protection against any US charges of bigamy, which is good for you. But I would still get proof of lack of intent to commit bigamy but showing the check paid to the foreign lawyer, and any retainer agreement explaining what he was going to do for you (and failed to do). Get your recorded marriage certificate, showing that you are currently married. She is never, obviously, going to be able to prove divorce or annulment, since it didn't happen. Meanwhile, it would behoove you to NOW get a real divorce from wife #1. You might be best off just chilling with the marriage ideas until you find a woman you know for a spell, whose background you can investigate a little more, who has a job and some financial security of her own, etc - no need to rush these things!
Incidentally, you may be able to divorce #1 from right here in the states. Get a local lawyer on that.
