I filled a charge of racial discrimination with the EEOC against my past employer in July '08 . I have yet to hear of any findings of the pending investigation also due to untrue sttatement by my employer I was disqulified for unemployment and ordered to repay over pay. I disagreeed with the final ruling how ever did not have the resources to file a Judicial Review. Since than Ive recently been laid off from my recent employer however I can not qualify for unemployment til the entire over payment is repaid due to untrue statement on behalf of my past employer. In addition I have been requesting distibution of my 401k since my termination Febuary '08 with the assistance of XXXXX XXXXXcock and The Dept of Labor to no avail. I dont what actions I should take next

I was basically told by my EEOC case worker that she has unsolved cases dated back as far as 2006 and she has yet to hear findings from the investigator.......They didi offer my employer mediation however they refused. Note in addition the information respone to the by past employer to EEOC conflict statement to TWC which shows and proves fruad by employer...........II addition I discovered that another employer during my tenure was subjected to similar discrimination/Harassment and Co agreeed to settle with him thru medition.
