In California, on a Commerical Month to Month lease... I have given 30 day notice to move out, and have not submitted rent yet, but the office has a notice that states to the effect "based on your intent to move out and default of the lease your lease has been terminated". The default I am guessing would be the non payment of rent. They have changed the locks on the door. They have not provided a 3 day notice nor have we had a court date so they do not have a court order... is them changing the lock without notice or court order legal?

Answer: Unfortunately, it is legal. The protections against lock-out are only for residential tenants. Commercial tenants are not afforded the same protections under California law, so your landlord does not need a court order, nor does he even need to provide you with notice. I wish I had better news for you.
