Last year my six year old daughter was diagnosed with a hole in her heart. Her cardiologist who made the diagnosis operated on her to close the opening. During the operation he discovered that he had made a mistake with the diagnosis, she did not have a hole after all. My daughter went through surgery for no reason and my wife and I have experienced medical bills for an operation that was not needed.
Gender: girlAge: she is now 7 Already Tried: contacted local malpractice lawyer. He is only interested if has been permanently harmed
Hi, Dr. Hill here. First I'm terribly sorry to hear about what happened to your daughter. I can only imagine the distress it caused you and her. I guess I'm wondering at this point if you have a question, and if you do is it best addressed to the Pediatrics forum of Just Answer, or the Legal forum?

I live in Winter Springs, FL. My wife contacted Morgan & Morgan and they don't want to handle teh case unless my daughter suddenly becomes very ill or dies from the surgery.
Thank you for the information. Unfortunately the response you received from the law firm will be common. In medical malpractice cases the firm will focus upon the possible jury verdict/award amount compared to the time and labor involved in litigation of such a case. However, don't give up hope because you will be able to find an attorney willing to help you, it may just take more effort. I suggest you contact your local attorney bar association to find a listing of malpractice attorneys or contact a general practice attorney. I would need to review the medical records to make a definate statement, but it appears you do have a case based upon what you have shared here with me today. I wish you and your family the best.
