I have been working for a retail compoany for 15 years as a store manager and until recently had every intention of working there until I chose to retire. About 4 months ago things changed: I had a conversation with our Regional Manager where she stated that the job was changing and that she was having the same conversation with some of the older managers as to their ability to deal with these changes. She has since been fired and the discussions have been picked up with the District Manager. On one occasion the DSM stated to me that at my age and at this time in my life did I really want all this work. She suggested that I might want to drop down to Full time sales or an Asst Mgr. position and there was one in another store. I said no. It was brought up again several weeks later by me and she said it was still available and I had to let her know in 3 days. I let her know that I was interested but that I needed to know the particulars in regard to salary. I have more

This is a classic case of age discrimination and what you need to do is contact the EEOC and file a complaint. You need to document all of these comments made about your age and suggesting you drop down to the asst mgr position and file your complaint with the EEOC. You should also at the same time notify the employer's corporate HR/EEO officer that this is age discrimination and is against the Age Discrimination in Employment Act (ADEA). If they retaliate against you for making this complaint, then you would have a separate claim against them for retaliation which can be sustained even if the original claim is not sustained.
