I was arrested for DUI after I moved to Phoenix Az. I was guilty and I accept any penaties that were given me. This is the only ticket I have recieved in the last 40 years. I was taking my mother who I was taking care of for the last year and was driving across the street to get some medicine her some medicine. To make a long story short the person in front of me was starting to make a tune into our complex but stopped. I began to follow howevere my exellerator stock and I hit here at about 5 mph. I went to court, with an attorney and plead guilty. Amoung several classes I was required to take and many dollars I was required to have an ignition interloc put on my car. Once a month I would go back to Smart Start to have it checked to see if I drinking while driving. Durining the entire year I never did have a positive alcohol reading. On my last month Smart and Start said I had Tampered and circumvented the system. The MVD in Az. extented me 1yr witout a hearing. Can you help?
State/Country relating to Question: Arizona Already Tried: Contacted the Smart Start people but with no help. They were unable to locate any paperwork I gave them. I gave it to them for the third time and they told me to wait for an answer. I then contacted the mvd office and they told me that Smart Start was sending another letter that I needed to respond to. The statement that Smart Start were untrue. If they can't prove their allegations then it seems they have falsified a legal document and caused me unusual discrace. I feel this company should be held to answer for their actions as well as every Smart Start in other states. The MVD has extended my 1 year obligation with the Smart Start ignition inter lock devise for 1 more year. This is because of false statements made by Smart Start and their unwillingness to explain or cooperate with me in this matter. I would like some one to either represent me at a future or give me the advise I need to do it myself.
When an administrative action is taken by a Motor Vehicle Department, the motor's primary option to challenge that action is through the Arizona Office of Administrative hearings. Basically, the AOH must be petitioned, and an evidence hearing is set before an administrative law judge, who then hears the evidence and renders a decision. Someone can do this themselves, but it's always best to enlist the aid of legal counsel if doing so is an option. Any local criminal defense attorney who handles DUIs should have sufficient familiarity with this process to give you the assistance that you need.
