I live in Oregon and am a independent contractor / hairdresser. I am set up with a credit card processing company by the name of United BankCard. Within the last two and a half years that I have used their services they have taken out funds from my bank account 3 different times without my prior knowledge or any type of communication or explanation. When I call to see what the charge was for they always say it is a "one time" charge for one thing or another. These withdrawals from my account have ranged from $76 to $89. My question is, isn't it illegal to take funds from a person's account without some sort of communcation regarding the pending transaction. When I do call and complain, they always refund the money. Seems pretty shady to me. Just wanted a legal opinion. Thanks. XXXXX hairdresser in Albany, Oregon
State/Country relating to Question: Oregon Already Tried: I have contacted the business and complained about the charges which after being put on hold for a good portion of the time and much frustration, they say they will refund the money to my account.
Good evening Carla,
In your user agreement does it say anything about periodic or one-time charges?
I don't believe so.
ok, assuming it does not permit them to charge your account, you can terminate the agreement for breach of contract.
