If I live in Missouri, Can A Creditor in Kansas Garnish my Wages Under kansas Law IF I LIVE IN Missouri Jurisdiction???
Already Tried: judgment was obtained in Kansas from C. Union by their attorney, ( that is in motion to compel ) BUT CAN OR SHOULD THEY USE governing STATE I reside in to garnish me???
Since eacj state is given full faith and credit to a judgment in another state, yes they can garnish your wages and probably will. Please press the "accept" button so I may be credited and paid for my time when I have answered your question. . eacj state?? U stated judgment in other state, but the Judgement is in Kansas and originated in Kansas. However, I live in Missouri. Can you elaborate the above and confirm and i would be happy to accept.. thanks, dc
Even if the judgment is in Kansas and originated in Kansas, because both states give each other full faith and credit in each others courts, as do all states in the United States, then they will have to bring the judgment from Kansas, file it in Missouri and execute it there and subsequently garnish your wages. It will be converted into a judgment to be executed in Missouri. Please press the "accept" button so I may be credited and paid for my time when I have answered your question. . As previously stated: They are not bringing it to Missouri to execute. It's executed in Kansas and THEY are GARNISHING 2,000 dollars a month from my 8,000 per month salary. Are you saying they should have Executed it in My presiding state or not?? the answer to that question will answer my original question of proper governing jurisdiction between
Yes, they would have needed to bring it to Missouri, and have the court in Missouri recognize the debt and as a Missouri judgment, then they could execute. I would hire an attorney to fight the jurisdiction. Let them go to the time and expense of doing it right. Please press the "accept" button so I may be credited and paid for my time when I have answered your question. .
