What Customers are Saying

  • My first experience with Just Answer has been better than I ever thought possible. I had a fairly complex legal question regarding Medicare provider regulations. For a week I had been trying to find an attorney familiar with Medicare but to no avail. I really didn't expect anyone at Just Answer to know anything about this issue. Yet the attorney who answered my question, Dimitry Alexander Kaplun, Esq., not only answered the question but cited the specific Medicare regulation in question. For six years, I was a Westlaw representative so I've worked with hundreds of attorneys. Some attorneys are knowledgable and some aren't, especially about administrative law. But Mr. Kaplun clearly had an exceptional understanding of the issue and was able to explain it concisely. I would recommend Just Answer to anyone. Great service that lives up to it's promises!

Expert's Answer

Since eacj state is given full faith and credit to a judgment in another state, yes they can garnish your wages and probably will. Please press the "accept" button so I may be credited and paid for my time when I have answered your question. . Positive feedback or a bonus is always appreciated. The responses don't create an attorney client relationship Thank you very much.

Expert's Answer

Even if the judgment is in Kansas and originated in Kansas, because both states give each other full faith and credit in each others courts, as do all states in the United States, then they will have to bring the judgment from Kansas, file it in Missouri and execute it there and subsequently garnish your wages. It will be converted into a judgment to be executed in Missouri. Please press the "accept" button so I may be credited and paid for my time when I have answered your question. . Positive feedback or a bonus is always appreciated. The responses don't create an attorney client relationship Thank you very much.

As previously stated: They are not bringing it to Missouri to execute. It's executed in Kansas and THEY are GARNISHING 2,000 dollars a month from my 8,000 per month salary. Are you saying they should have Executed it in My presiding state or not?? the answer to that question will answer my original question of proper governing jurisdiction between

Accepted Answer

Yes, they would have needed to bring it to Missouri, and have the court in Missouri recognize the debt and as a Missouri judgment, then they could execute. I would hire an attorney to fight the jurisdiction. Let them go to the time and expense of doing it right. Please press the "accept" button so I may be credited and paid for my time when I have answered your question. . Positive feedback or a bonus is always appreciated. The responses don't create an attorney client relationship Thank you very much.
