I sold a VW car with 105, 000 miles for $2000 (below blue book price) off Craigslist. The people who bought the car test drove it twice, brought it to my mechanic for a quick question BUT did not get it checked by their own mechanic. They asked for 1800 and I said I was firm with the price as I was told by my mechanic that it was a great deal ( I origanally priced it at $2200). I gave them all the paper work for their review. I had recently put 1500 in the car was barely making any money off the sale. They bought the car, signed the paperwork and I sent my information to the DMV. Later that night I received several calls and emails saying they heard a noise when in reverse , took it to their mechanic and said the car needed a new transmission and clutch (in my paperwork it showed that the clutch was replaced in 2005). My mechanic differs. Now they want $500, or they want to return the car or go to Small Claims. Can you please give me advise. Thank you!
State/Country relating to Question: California Already Tried: am waiting to hear back. The owners keep emailing me and even stopped by my home. I was not home but my husband was and dealt with the buyer. I have a new 4 month baby and having this family call, email and come to my house is very unsettlng. I sold a a good car. I'm not a mechanic and wish they had the car looked at prior to their purchase. I was told by mechanic that it was in good shape. And he continues to stand by this.
HiCustomer did you have a written contract or agreement with the buyers? If so, did it contain the phrase "AS IS"?
We had no written contract or agreement. my add on craigslist did not say AS IS-- but i guess it would be assumed. I never said that car could be returned or that they could get money back. I feel terrible but what to do? They said I said they could contact me within 2 weeks after teh purchase. I do not recall saying that. They ask for $500 and they will keep the car and make repairs ( the total cost is aorund 1800-according to their mechanic). My mechanic says they don't need this work done.
Hi again: well, your mechanic looked it over shortly before the purchase, so there's pretty good evidence that there was no problem with the vehicle at the time of sale. If there was no problem at the time of sale, they are out of luck. That said, it is a USED car, but they could still argue that there were undisclosed, hidden defects that made the car worth less than they paid, and recover the difference. So, if the car is worth $2,000 with the busted transmission, they can go fly a kite. If it is worth $1,900, you could be potentially liable for the difference.
