If you have a pair of tickets for an event that you cannot use (just one pair) and you are trying to sell them, is it illegal in either NYS or Canada to sell to the person that is willing to give you the most money, or is this illegal scalping? Trying to solve a moral dilemma from people who think this is something "immoral" haha I used the example that if I wanted to buy your dirty underwear for $10,000 and someone else would pay $12,000, would this be considered scalping? Never mind the tax consequences, the person who got $12,000 for dirty underwear, besides being really really lucky, would have to worry about paying themselves. Am I right or am I wrong?
The scalping laws in NYS have been repealed so now it is not scalping to sell to the highest bidder.

what if the transaction if from a Canadian seller to an American purchaser
It is technically not legal to scalp in Canada but the law is widely ignored so unless someone just has it out for you it is unlikely you will be prosecuted.
thank you
