under FMLA, can the employer not allow the employee to discuss or be involved in any part of the bussiness until he/she returns to work. My employer sent me a letter and also told the compant not to talk to me until i am released back full time
Under the Family Medical Leave Act, once you ask for time off from your employer due to a medical condition or pregnancy, it is up to your current employer to keep you involved or not--the whole point of the Act is to give you uninterrupted time to get better and in the process make sure that your position remains available. If you attempt to get active in the company, the employer may argue that you are not in need of the FMLA time and can request that you come back to work full-time (or terminate you for cause, for Fraud). Sincerely, Dimitry Alexander Kaplun, Esq.
