the dealer sales person told me that the vehicle I purchased was in great condition and the only reason they were selling it at such a low price was because of some problems with the interior. as it turns out, the vehicle had quit a few problems which we are still trying to fix, the needed repairs became noticeable by the second day. the dealer fixed one of the problems only after insisting and has no further desire to comply with any more of the needed repairs. they told me that it was now my car and my problem, they have spent too much money on the vehicle and will not help with any other repairs. the vehicle is a Nissan xterra 2005. it originally had about 81,500 miles and currently has 82,230 miles most of which come from traveling to and from the dealership and to the auto shop. during the actual sale of the vehicle the sales person changed us to a different sales person after he found out that we were not going to be financed through them, and messed up our paper work.
State/Country relating to Question: Michigan Already Tried: lemon law and BBB and talking with the dealer
Good afternoon,I'm sorry to hear of your dilemma.About your only remedy is to sue the dealer for Breach of Contract and Fraud in the Inducement, and seek to have the purchase agreement voided so you can return the car. If you haven't already, ask them to accept the vehicle back in exchange for all you gave for it.If they refuse, tell them that you are going to file suit as I suggested above, and then do it. The threat alone might get them to cooperate further with you.I wish you well.
Best regards,
Doug
based on what I told you how good are my chaneces of winning the case if i do file agenst the dealership?
If you can prove that the sales person lied to you about the condition of the car, you have a very good chance of winning. No one is allowed to fraudulently represent the condition of a vehicle they are trying to sell.
