I had a independent contractor working for my trucking company. I owe him around 14,000 dollars. I sent him a check for 2500 and a letter stating the payments i would be able to give him. once I have done this do you think he would still have legal grounds to sue me?
State/Country relating to Question: California Already Tried: I just sent a certified letter and check. In the letter i stated that we did owe the money and we would send him 2500 per month until the amount was paid in full. I did receive the proof of delivery back from the post office but they have not cashed the check yet
The contractor has grounds to sue you for what you owe him unless you get him to agree to your proposed payment plan. You should ask the contactor to send you a letter acknowledging the payment schedule. If he cashes the check, it would create some level of his agreeing to your proposal, but this would not be "offical" until/unless you get him to sign off on the agreement. If you don't get this, the contractor can sue you at any time for the outstanding money you owe him. Adam Kirk40049.633531331
