My 23 year old Daughter's boy friend(they lived togather for a year) broke up with her. She went to live with my ex-wife. The ex boy friend called her up and asked her to come over to talk(my daughter is under the care of a doctor to try and figure out the meds she needs to combat ADD/Bi-Polarism,and has yet to find the proper combination) The "talks" turned bad and he asked her to leave. She refused so her called the police. He gave her multiple oppertunities to leave but she refused. The police called the house to ask my Daughter why she was still there, she said"because I'm not done talking yet". The exboyfriend told her "they are on the way", she said "what ever"! The police showed up, arrested her for misdemeanor criminal tresspass and was taken to jail, the exboyfriend did not press charges. She spent 10 hours in jail until she bonded out($500.00) Does she need a lawyer?, will she go back to Jail ?, a fine ? She is scared to death.

HelloCustomerIf the ex-boyfriend is not pressing charges, then it is unlikely that the prosecutors will pursue charges against her. It is possible, however. Although no charge has been filed yet, your daughter was required to post bond. In circumstances such as this, the police reports are typically sent to the prosecutor's office for review.It is up to the prosecutor to decide whether or not to pursue charges. If the prosecutor does pursue charges, then your daughter should definitely get an attorney. She will not need one unless charges are filed.
