My X keeps filing Temp Injunction Orders against me, the first 2 he dropped, now this Wed have a court date so he can make this one perment. My question is I do not want to go to the hearing, I am tired of this and can't play his games anymore. Is it legal for me to not showm, and if I do not will the judge automatically grant the Injunction for life?????????????????? Regards, Laura
State/Country relating to Question: Florida Already Tried: I reside in St Petersburg, Florida Pinellas County! I have not tried anything, he has willing dropped both, but now since he has a new girfriend he said he want me 500 feet away from him, his work and his home for the rest of my life. I dont want to go to the hearing for I do not want to see him nor have the energy to fight him on these injunctions every other week!
Hello,
You are not legally obligated to appear, but if you don't, the judge will listen to your ex's arguments in favor of a permanent injunction and likely rule in his favor. The judge will look at this as you are either not interested in defending the action or are acquiescing to the request. If there are no grounds to the claim, I would suggest appearing and vigorously defending the action as his actions would be considered Harassment if he just files the actions to annoy you.
Thanks.
Matt
Matt: He has copies of all my texts messages and emails, and had me arrested in june for domestic, and then charges were dropped. I He hit me then I hit hit his hand and when the police came they arrested me. I also suffer from OCD~ so my texts and call volume were extremly high. He has all his documentation, and I am afraid if the judge drops it I will continue to cal and text of fault of my own. What I really need to know is if the injunction usually becomes for life or maybe just a year being I am not violent never gone to his work or house since I have moved out 2 months ago. Please Advise. Sincerely, Laura
In Florida the duration of the permanent restraining order is not set until the judge rules. He has the authority to issue it from 3 years to life depending on the circumstances. If you opt not to attend the hearing, the court will mail you a copy of the order so that you will know for sure how long it will be in place.
Thanks
