i live in clarksville, tn. We terminated our lease and moved out. We live in this apartment from 25 nov 98 to 31 jul 09. the land lord charged us a 75.00 dollar admin fee and 191.07 for stains on carpet and damage vinyl floor. The 75.00 dollar admin fee was never told to us. That we had to pay just to get our deposit back! Is this legal?
State/Country relating to Question: Tennessee Already Tried: Thought about going to small claims court, if not legal. Never were we told when were leaving the apartment that we would have to pay a admin fee, just to get our money back! montgomery county, clarksville, tn total amout of deposit was 485.00 minus 75.00 admin fee minus damages of 191.07. They sent us a check for 218.93. Which we are not cashing until this is settled. Also I think living in that apartment for over 10years and has a few stains is fair wear and tear, since it was not brand new when we moved in.
There is nothing in the Tennessee Landlord and Tenant Law that provides for the administration fee. Thus, the charge is illegal. Make a written demand to the Landlord for this money to be returned you. If the money is not returned, then file a complaint with TN Consumer Affairs Division:
