I cosigned for a person to get a car, but when they stopped paying the payments the car loan place called me and said i was the only person on the contract. when i asked for a copy of the contract my name was not my signature someone tried to sign my name it does not look like my signature. What can i do because they repossed the car from that person but it is on my credit.
State/Country relating to Question: New York Already Tried: before i deployed i talked with the loan company and told them that i didn't sign in the primary account spot. right after then i deployed and the car should have been repossed. so i am back i want to know what i need to do to get this car off of my credit.
<p>DearCustomer- I am somewhat confused by your fact situation. You say you cosigned for the loan but now say it is not your signature. If you cosigned for the loan you can be held responsible however if you did not sign the loan then you can contest any action to collect. You should also write a letter to the credit bureau and dispute the account. </p><p> </p><p>If the loan company has sent the wrong document then you have a right to force them to show you the correct loan documents to prove their account. the first form i signed was in the cosigner spot. This contract here is not the one i signed. i don't sign my name like what is on the contract that is what i told the loan supervisor that is the reason i have the paper work she had to send it to me because before the deal was finished i left fort drum and haven't returned since
if they do not have your signeature on the note and this is a forged document you can certainly contest the debt and file an objection with the credit bureau. Unless they produce a signed, valid note you have no obligation for this debt. I would definitely file a letter of dispute with the credit bureau and also with the loan company. You need to do this in writing since telephone calls will do you no good. Dave
