can a Florida employer, actually a county health department, tell you to take a half hour lunch break and say you cannot leave the premises?
State/Country relating to Question: Florida Already Tried: I'm a school nurse and we're required to take our half hour unpaid lunch, but we've been told we may not leave the school campus "in case we're needed". The supervisor also said that Florida law actually does not provide for rest breaks or lunch breaks during our day. We work 7 hours plus the half hour lunch. My day is 8:30am to 4pm. My point is that if the employer is controlling our time and location, then they should have to pay us. This isn't really a problem for me, but I know other nurses that would like to run to the bank at lunch, McDonalds, etc. Thank you.
If there is a lunch break provided, the employee has to be permitted to do with that time as one pleases. If limited, that time has to be paid for.
