I bought a 1965 mustang from Ohio on e-bay for $10,000.00. I have an e-mail from the seller that clearly indicates the car has "no rust". The car was delivered to me in Califorina and has a lot of under body rust. I have 3 estimates that average $7,250.00 for the rust repair. I want to return the car because the seller clearly misreprsented the condition of the car. The selller is dragging his feet; keeps telling me he will call me later to discuss. What are my options?

I owned a '65 Mustang Convertible myself--nice cars those '65s!!It seems pretty clear that the seller intends to leave you as you are and would prefer to avoid the situation any further.You are really inly left with filing a lawsuit for breach of contract and Fraud in the inducement. I suggest that you file the suit as soon as possible in the county where the defendant lives.As soon as they see the fraud allegation, knowing that they could be hit with tens of thousands of dollars in punitive damages on to of the purchase price, I suspect that they will become much more agreeable.I wish you the best.
