in oregon, after my 1st court appearance in which a restraining order was served, does the court investigate the facts i wrote on the affidavit such as the 911 calls i made, and contact the doctor who was verbally assaulted by her since i stated his name and work address, or do i need to obtain 911 records and get a written statement from the doctor myself before the hearing?thx
State/Country relating to Question: Oregon Already Tried: i made 2 911 calls on seperate occasions (before a 180 day period of filing restrain order) for her kicking my door in, with child on her back, the police showed up-she admitted she kicked door in to the poilice-do they have 911 calls on file and do courts investigate before hearing and can i obtain 911 recordings for evidence at hearing?
The court does not do any independent investigations in retraining order matters. They consider only the evidence brought before them by the parties. The court clerk can issue subpoenas for a party so they can be filled out and served. If this information was helpful, please click ACCEPT to give me credit for answering. i wasn't quite finished w/ question, can i obtain 911 recordings from police station to use at the hearing?
Generally, yes. If the person made the call, they can obtain them simply by contacting the police department. If not, they would need to have the clerk of the court issue a subpoena and have it served on the police department's custodian of records.
