can the ma respiratory care board deny a license if charges were dismissed on a cori
State/Country relating to Question: Massachusetts
Thanks for your question. They can try here. You can appeal here and seek hearing before the board or authority in this matter. But here is the question I thik they have you denied on here and it includes arrest.. "Have you ever been arrested, charged, arraigned, indicted, prosecuted, convicted or been the subject of any criminal investigation or any court proceeding in relation to any criminal violation? Do not report minor violations for which a fine of $100 or less was imposed. " You may want to check into expungment here to clear your record and then try to reapply..
the application states that a cori is investigated further for criminal convictions or impending ongoing cases ONLY. I was arrested but then all was dismissed. INNOCENT UNTIL PROVEN GUILTY right? You can be arrested for many reasons doent seal your fate for a cop to make a mistake does it? I asked a couple attorneys and the CHSB about sealing my file...the all said that if I seal my file people will assume the worst and if i leave it open it looks better becouse it shows no guilt.
I won't dispute this. All you can do is take your right to appeal here and you may even have to file civil suit here. It will take an administrative lawyer to challenge.I mean I personally agree with you wholeheartedly. I think they are overreaching here and a judge might well see it you way and license you here overturning the denial. With these things you just have to hunker down, lawyer up, and prepare for a fight unless they surrender along the way.I wish you well because I agree you are an innocent man under the law..
