I live in Houston, TX, Harris County. I need information on wage garnishment. Can a debt collector place a garnishment that will take so much from your paycheck that a person cannot pay their rent, car note and electric? The debt is not being disputed but unfortunately, it was a loan from a "payday" loan establishment to pay medical expenses. The interest is exorbitant. In hindsight it was a really, really dumb move but it is done. I am not trying to get out of paying but have been advised by friends to pay rent, electric and car note first, then worry about the payday loan but I am afraid that if a garnishment goes through, there will be nothing left to live on. Is there anywhere in Harris County where I can get some legal aid? Thanks.
Already Tried: I have tried talking to the debt collector but as you can imagine they have probably heard it all and have little empathy for my situation.
You need to appeal the garnishment of wages for this, since wages are exempt from garnishment under the Texas law. At this point you need to go to the legal aid office in Houston and you can also call the state bar and ask for the pro bono attorneys in the area who can assist you. You need to file an objection to the garnishment as being against the law.
