Is a sub-lessee entitled to the same notice in an eviction as a tenant?
State/Country relating to Question: California Already Tried: My son is a sublessee in Concord, California, and his roommate is the tenant who is subletting a room to him. There was an oral agreement that my son would rent on a month to month basis. He recently moved in, and has not put things away in his room. He (my son), agreed to put everything away in his room by Sunday. He was planning to do so. Yesterday, my son received an e-mail from the tenant saying that he was evicting my son as of this Sunday, which is Aug. 22, 2009. That is, the tenant wants my son completely out of the apt. on Sunday and paying the remainder of the month's rent. As a sub-lessee, what rights does my son have. Thank you.
That is correct. The same due process requirement applies to the sub tenant.
