In Texas, can a creditor garnish or sieze a persons bank account if they are owed money? My grandmother co-signed a student loan for my sister. My sister has been having trouble paying the bill regularly. They are threatening to sieze my grandmothers bank accounts. They are also threatening to take her home. Can they do that.
State/Country relating to Question: Texas Already Tried: My sister has talked to them several times and tried to come up with a payment plan. I don't know of anything else they have tried beside talking to them.
In Texas, garnishment or seizure is only possible with a municipal debt (e.g. taxes or federal student loans). private lenders cannot freeze a home or garnish or take a home in Texas.
By Federal Student Loans what do you mean. My sister has a Student Loan with Sallie Mae. Would the be considered private or are they considered federal.
that would be considered private, but Federal Direct Loan would be a government loan.
