Ex husband has opened several credit cards using my social security number - totalling up to $70,000 since our divorce. Also he is still using my insurance card from a previous employer and I am now receiving calls and bills from credit cards and doctors offices. I did speak to an attorney and his advice to ME was to file bankruptcy. This is a quick fix for me, but still allows my ex husband to keep on with his fradulent activities. What type of laws are there in Arkansas to protect me so that I am not responsible for him - I am remarried and have been divorced from him for two years.
State/Country relating to Question: Arkansas Already Tried: Consultation with Attorney - His advice was to file personal bankruptcy. This would only "clear" the items so that I would not have to pay everything - This is the SECOND time this has happened - He would only do it again.
Thanks for the chance to assist If he is using your information to open up credit accounts without your permission, your first call should be to the police. This is illegal in AR as well in all other states. Next, you need to notify the creditors for these accounts that you did not open them and that you are not legally responsible for the debts. You also need to notify the credit reporting agencies of this. If you did not authorize or benefit from these accounts, you are not required to pay for them. Please let me know if you have further questions; if so I will do my best to answer them. If not please hit the accept button, its the only way I get credit for my work.
