i have a one year old son and my and the childs father split up about 5 months ago. We have come to an agreement that he will give me $140.00 a week to pay for daycare. We just wanted the judge to sign off on it or an attorney so that we both have an agreement in writing stating that he is going to pay that amount and that is it. He has two other children so i do not want to take him to court with DSS and have to hire attorneys and all that. What is the easiest way of doing this?

He is willing to go to court with me or sign legal documents stating that he will pay me an amount of $140.00 for daycare costs and we sat down and talked about this in full agreement. yes he is on the birth certificate and i have pictures of him in the hospital and he is fully willing to sign documents to pay the childsupport and he knows he is the father
got it OK, you have a couple of options. If you want a court order, you will need to go into court. This requires you retain an attorney, OR contact DSS...but if you contact DSS, they will set this up so that he pays DSS and not you. You can certainly get him to sign an agreement...this would be a contract...and if he violates it you could then go into court to enforce (and, it could be the court would actually increase the amount if this happens). It's important to understand that the court can enforce an agreement where he agrees to pay more than required by law...but will not if the agreement is for less than required by law (this is good, since it protects you) As for the form to use, you can search google for "child support agreement template" and get some options, or you can draft your own. There is not a "standard" form required by the court, so long as its in writing, he acknowledges paternity and agrees to a particular amount per week/month you will be fine Please let me know if you have further questions; if so I will do my best to answer them. I do not want him to come back in 3 months or two years and say hey, i got a paycut and i cant pay you though or some other thing.. So as long as i put everything i need in writing and everything i want to happen in writing and have it notarized is it a legal binding document and does he have to abide by it in the courts?
If you have an agreement, signed by BOTH of you, where he agrees to a particular amount, then yes, if he does not honor it, you can take him to court and the court can either 1. order him to pay that amount (the one you agreed to) OR 2. order him to pay MORE money each week (if the amount you agree to is less than the state guidelines)
