how do go about creating a video with a partner so that I have rights to my video after we finished filming it and editing it. Do I copyright it first and creat a contract. If so, what should the contract say? XXX@XXXXXX.XXX
State/Country relating to Question: Michigan Already Tried: Nothing yet. I am a lecturer about the nutritional products of my business. My fellow colleagues want to video tape it, so they can use it to teach others. I would like it videotaped but I would like to set it up so that I own the the rights of the DVD and want to know how do I go about doing that. I also want to put my nutrition information in booklet form and I want to own the rights to that and market that too. I need to know what I should do first in order to secure my rights to the Video and the booklet before we start making the video.
HiCustomer we are not going to be able to write the contract with you, but I can let you know what some of the important elements would be. Would that suffice?
The information that you have provided does not give me any indication that what you are going to tell me is something that I can use. Perhaps it would be better if you possibly handed the question to an entertainment lawyer or ask an entertainment lawyer my questions to give me an indication that what you would offer can help point me in the right direction.
How do I make contract to produce a video with a fellow colleague. how do i copyright the video so that I have rights to market it.?
Customer It appears that you opted out from the prior Expert's assistance. I do have experience with a variety of contracts, including those that deal with intellectual property, copyrights, and entertainment law. However, I agree with the previous expert. Experts at JustAnswer.com are prohibited from actively writing the contract for you because that would constitute active representation and would become an attorney-client relationship, which is something we are barred from doing because we are not licensed in your state. I can, however, try to help you with certain clauses that you would need to include in the contract. Would that suffice? Please advise. Sincerely, XXXXX XXX.
Yes I understand that you cannot write the contract. I did not want that. I wanted advice as how to go about writing one. So I would like to know key clauses or subject matter that need to be included. and also how to go about getting the copyright - or if I there is something more that I should do beside the copyright?
What your contract has to have is an express waiver of rights that the other partner must sign. The waiver should specify that you retain the right to reproduce, edit, resell, and have sole ownership to the finished end-product, and that the other partner agrees that he or she has no inherent rights to the intellectual property and that he or she cannot do anything with the end product (or any parts of the movie) without written consent from you. That is a very rough sketch of things you should consider, but it should give you a good start. I do suggest you list and brainstorm about all of the options you want to retain for yourself, and all the options you want the other partner to give up. Sincerely, Dimitry Alexander Kaplun, Esq.
