My employer cancelled my and my family's group medical insurance without any notification to me. I found out by going to a medical clinic this morning. I changed from a full time manager to a part time straight commission salesperson on 1/01/09 but our verbal agreement was that he would continue to cover my insurance and subtract it from my commissions. My last sale and commission were in May 2009 but he cancelled my coverage on August 19, 2009 and cancelled it retroactive to July 1, meaning I am covered only through June 30, and I will have thousands of dollars of recalculated doctors bills coming. I received no verbal, nor written, or any other type of communication that my employment was terminated nor that my coverage was terminated. He only has about 10 employees, but I still didnt think it was legal to cancel an employee's health coverage without terminating the employee or sending them some sort of formal notice/warning? Did he act illegally and if so what is my recourse? Thanks
State/Country relating to Question: Louisiana Already Tried: Talked with my employer and he offered to offer me cobra coverage with the new govt subsidy, but I will have to pay for june, july and august since he did not notify me. i thought if he terminated me today and he'd already paid coverage, then whether or not I had earned enough commissions to cover my medical insurance, he was still liable for the cost because just like a salary or a guarantee he was hoping, as i was , that there would be sales to cover it!
