My son is going to meditation next week to seek custody of his two children. The mother has the children now and in order for my son to see the kids this week end she is asking him to sign a paper saying he will have the kids back to her place in 2 days of receiving them. She is fearfull that he will not return them to her. There is no court order in place yet. She said her lawyer advice her to have the father sign these papers. Is this legal on her part?
Thank you for contacting our JA team for guidance.
Since there is no court order in place, it is legal for her to request that he sign the document. If he intends to return the children in 2 days anyway, he should go ahead and sign it, although it should specify a date and time since there does not appear to be much trust between the two of them. He doesn't want her calling the police if she interprets the agreement different than he does.
Please let me know if you need additional information.
