A magazine company called Reader's Services of America obtained my information from a credit card company that I have. They opened two accounts in my name after I only agreed to open one. I requested that they close both accounts and they only closed one. They then took money off the credit card and I called back immediately to close it because of Fraud charges, they claimed they did not but I have my statements. They would not close it and would not allow me to speak with a supervisor or manager. It has been going on for about 6 months. There is no written agreements with this company and they do not have my SS#. Can they still post a negative account on my credit report?
State/Country relating to Question: Texas Already Tried: I already tried talking with them several times. When the first account was closed the supervisor sent out a letter that did not refer to it as a fraudulent account but it just said that I wanted it closed. Since then, they have been calling several times a day even after I told them about taking money out of my account and told them to close it and stop sending magazines to my home. I looked for them on the BBB list but they are not there. They operate under several names but the one on the most recent letters are Reader's Services of America.
They can post a negative comment on your report and you would have the right to dispute it under the Fair Credit Reporting Act by sending a letter to all of the credit bureaus with your proof and a copy to the company. If they do not correct the remark within 30 days you can sue them for damages. As far as the money you paid, if your credit card company will not refund the charge, you can first file a complaint with the State Attorney General's consumer affairs unit and if they cannot resolve the matter you would have to sue the company to recover your money.

They are still able to file against me even though there is no binding agreement with them? They have no paperwork and no recordings stating that I agreed to all of this. I have tried to reach them many times with no resolution, so basically there is nothing I can do besides going to the State Attorney General. Do I need to send copies of everything that I have? This company will not even talk to me unless pay them first.
