No it is not embezzlement but the wife must claim the money as part of the assets that she has already been compensated with as part of the division of property in the divorce. It is just like taking the money from your joint checking account if you were joint owners of the business.

im already divorced and walked away with taking nothing but my children it was an abusive situation and i just wanted out. He had a business checking account with me listed as a signer.
